1. Purpose
At New Generation Montessori Schools (“we,” “our,” or “the School”), the safety, dignity, and well-being of every child is our highest priority.
This Misconduct Report Policy establishes clear procedures for identifying, reporting, and responding to any suspected misconduct, abuse, neglect, or inappropriate behavior in compliance with:
- Florida Department of Children and Families (DCF)
- Florida Statutes Chapter 39 (Child Protection)
- Applicable regulations in Broward and Palm Beach Counties
2. Definition of Misconduct
Misconduct includes, but is not limited to:
- Physical abuse
- Emotional or psychological abuse
- Sexual abuse or inappropriate behavior
- Neglect or failure to provide proper supervision
- Verbal threats or intimidation
- Inappropriate discipline practices
- Child endangerment
- Staff misconduct toward children or other staff
- Child-on-child harmful behavior
3. Mandatory Reporting Requirement
Under Florida law, all individuals are mandatory reporters.
Any person who knows or has reasonable cause to suspect that a child is abused, abandoned, or neglected must immediately report it to the Florida Abuse Hotline.
This includes:
- Teachers
- Staff members
- Administrators
- Volunteers
- Any individual present on campus
Failure to report suspected abuse may result in legal consequences.
4. Reporting Procedures
A. Immediate Danger
If a child is in immediate danger:
- Call 911 immediately
B. Reporting to DCF
All suspected abuse or neglect must be reported immediately and directly to:

Reports may also be submitted online unless the situation requires urgent intervention.
⚠️ Internal reporting to the school does NOT replace the legal obligation to report directly to DCF.
C. Internal Reporting (Secondary Step)
After reporting to DCF, staff must:
- Notify the School Director or designated administrator
- Document the incident in writing
- Provide all relevant details known at the time
5. Required Information When Reporting
When making a report, provide (if known):
- Child’s name and age
- Location of the child
- Description of the suspected misconduct
- Name of the alleged individual(s) involved
- Any witnesses or supporting details
6. Confidentiality
- Reports are confidential and protected under Florida law
- The identity of the reporter is kept confidential
- Information is shared only with authorized authorities
7. Protection from Retaliation
The School strictly prohibits retaliation against any individual who:
- Reports suspected misconduct in good faith
- Participates in an investigation
Any act of retaliation will result in disciplinary action, up to and including termination.
8. Internal Response Procedures
Upon receiving a report, the School will:
- Ensure the immediate safety of the child
- Separate involved parties if necessary
- Fully cooperate with DCF and law enforcement
- Document all actions taken
- Take appropriate administrative action
Florida regulations require that facilities have procedures to protect the child and prevent recurrence during investigations.
9. Staff Training and Acknowledgment
All staff members:
- Must complete required DCF training on identifying and reporting abuse
- Must sign acknowledgment of their reporting responsibilities
- Must comply with all state-mandated reporting laws
Florida law requires child care personnel to be trained in identifying and reporting abuse and neglect.
10. Recordkeeping
The School will:
- Maintain secure records of internal reports
- Document timelines and actions taken
- Retain records in accordance with legal requirements
11. False Reporting
- Reports made in good faith are protected
- Knowingly false reports may be subject to disciplinary action and legal consequences
12. Compliance
This policy is designed to comply with:
- Florida Statutes §39.201 (Mandatory Reporting)
- Florida Administrative Code (Child Care Standards)
- DCF Child Care Licensing Requirements
